ARTICLE 1: INTRODUCTION AND ACCEPTANCE Welcome to Creative Thinkers Magazine (“Company”, “we”, “us”, or “our”). By accessing our website, purchasing our digital products (e.g., “Kadda Magazine”, “Digital Athpotha”), or subscribing to our AI-powered services (e.g., “Guru-Mind AI Assistant”), you (“User”, “Subscriber”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must discontinue use of our services immediately.
ARTICLE 2: SERVICE DESCRIPTION & DELIVERY 2.1 Digital Nature of Goods: All products offered on this platform are intangible, digital goods. No physical items will be shipped. 2.2 Instant Delivery: Upon successful payment processing, access to digital downloads or AI tools is granted immediately or within a reasonable automated processing timeframe. 2.3 AI Disclaimer: Our services utilize advanced Artificial Intelligence to generate educational content. While we strive for accuracy, the Company does not guarantee that AI-generated content (including lesson plans and legal drafts) is error-free. Users are professionally responsible for verifying all outputs.
ARTICLE 3: BILLING AND PAYMENTS We utilize a Hybrid Payment Architecture to ensure security and flexibility. We do not store your financial data on our servers.
3.1 Recurring Subscriptions (Via PayHere):
- Processor: Monthly subscription services are exclusively processed through PayHere (PayHere Private Limited), a Central Bank of Sri Lanka approved Payment Service Provider.
- Authorization: By subscribing, you explicitly authorize the Company to initiate recurring charges to your registered payment method via PayHere’s “Automated Charging” or “Recurring Billing” facilities.
- Billing Cycle: Fees are charged automatically at the beginning of each billing cycle. Failure of payment may result in immediate suspension of AI services.
3.2 One-Time Purchases (Via Onepay):
- Processor: Single transactions for lifetime access products or downloadable PDF bundles are processed securely via Onepay.
- Finality: One-time payments are non-refundable once the digital download link has been generated.
ARTICLE 4: USER CONDUCT AND ACCOUNT INTEGRITY 4.1 Account Security: You are responsible for maintaining the confidentiality of your login credentials. 4.2 Prohibition of Sharing: Your subscription is a “Single-User License”. Sharing your account details with other individuals (e.g., sharing a Teacher Account with the entire staff) is a violation of these Terms and may result in permanent account termination without refund.
ARTICLE 5: CANCELLATION AND TERMINATION 5.1 Cancellation by User: You may cancel your subscription at any time via the Member Dashboard. Cancellation prevents future charges but does not generate a refund for the current active month. 5.2 Termination by Company: We reserve the right to terminate accounts that violate our “Fair Use Policy” (e.g., excessive API usage beyond 200 pages/day) or engage in fraudulent activity.
ARTICLE 6: LIMITATION OF LIABILITY To the fullest extent permitted by law, Creative Thinkers Magazine shall not be liable for any indirect, incidental, or consequential damages arising from the use of our AI tools.
ARTICLE 7: GOVERNING LAW These Terms shall be governed by and defined following the laws of the Democratic Socialist Republic of Sri Lanka.
